1. PREAMBLE

This privacy policy is addressed to you as a "User" of the website "www.mondossiernotaire.fr" (hereinafter referred to as the "Site").

This Site is published by the notarial office ROUGER NOTAIRES

The notarial office ROUGER NOTAIRES and your notary place great importance on respecting your privacy and protecting personal data. As such, we strictly comply with data protection regulations, namely Law No. 78-17 of January 6, 1978, known as the Data Protection Act, and Regulation No. 2016/679 of April 27, 2016 (hereinafter the "General Data Protection Regulation").

This privacy policy aims to inform you of the commitments and measures taken by your notary to ensure respect for your privacy and the protection of your personal data.

The provisions of this privacy policy of the Site supplement those of the privacy policy of your notary's office website. In case of contradiction, the provisions of the notarial office's privacy policy shall prevail.

2. DATA CONTROLLER

Your notary acts as the data controller for the personal data of their clients, who are Users of the Site.

3. PURPOSE OF PROCESSING

3.1 PURPOSES

The processing implemented on the Site has explicit, legitimate, and determined purposes to ensure:
  • User authentication
  • Creation of the User profile
  • Access to files by the User
  • Scheduling appointments by the User
Your notary ensures the security and confidentiality of the personal data entrusted to them in accordance with applicable laws and regulations.

3.2 LEGAL BASIS

Under Article 6 of the General Data Protection Regulation, the processing must be lawful and based on a legal basis.
  • The processing carried out by your notary is necessary for the performance of a contract to which you are a party;
  • In some cases, processing is also required to comply with a legal obligation.

4. DATA PROCESSED

Your notary undertakes to comply with the legal provisions in force and to provide Site Users with complete information on the processing of their personal data, maintaining a register of data processing activities that reflects reality.

4.1 FOR ONLINE APPOINTMENT SCHEDULING ONLY

For online appointment scheduling, without logging into the client space, only the following data is collected: name, first name, email address, and phone number.

4.2 FOR CLIENT SPACE USAGE

Personal data collected by your notary for the use of the client space comes from multiple sources, including information you provide directly when using the Site or data automatically collected by your notary.
During Site use, you provide personal data at several stages:
  • Upon login: Username, password
  • When creating your profile: Name, first name, date of birth, country of birth, city of birth, email address, phone number, mailing address, postal code, city, and marital status.
  • When adding a new document: Name, first name, date of birth, phone number, mailing address, postal code, city, marital status, financial information, and income.
  • When making a payment: Name, first name

5. DATA RECIPIENTS

For the aforementioned purposes, your data may be transferred to:
  • Our subcontractors, provided they meet GDPR security and confidentiality requirements.
  • Legally authorized administrations or partners such as the General Directorate of Public Finance, notarial organizations, and central notarial registries.
  • Notarial offices involved in the transaction.
  • The Superior Council of Notaries or its delegate, to be recorded in a real estate database.
  • Public or private bodies for compliance checks, such as politically exposed persons screening, anti-money laundering, and counter-terrorism financing.
  • Relevant financial institutions, including the Caisse des Dépôts et Consignations for online payments.

6. DATA RETENTION PERIOD

Data is retained for the necessary period based on its processing purpose and legal obligations:
  • 30 years from the completion of the service for notarial files and registers.
  • 75 years for authentic deeds, client files, and notarial records.
  • 5 years from the dissolution date of a PACS (Civil Solidarity Pact).
Connection logs are retained for six months before deletion. Requests regarding data rights are stored for one year.

7. DATA SECURITY

Your notary implements technical and organizational measures to ensure a security level appropriate to the risk involved in processing personal data, ensuring data integrity, confidentiality, and accessibility.

8. EXERCISING YOUR RIGHTS

In accordance with data protection laws, you have the following rights:
  • Right to access and information: You can request access to your data and information on its processing.
  • Right to restrict processing: You can request processing limitations in specific cases.
  • Right to rectification and deletion: You can request correction or deletion of incorrect or incomplete data.
  • Right to object: You can oppose the processing of your data on the Site.
  • Right to data portability: You can obtain your provided data in a structured format.
  • Right to define data use after death: You can specify instructions for your data posthumously.
  • Right to file a complaint: You can submit a complaint to the CNIL.

Terms and Conditions of Sale

The information collected on this form is recorded in a computerized file by ROUGER NOTAIRES for the execution and processing of online payment. The legal basis for processing is the execution of the contract.

The data collected on this page will be communicated only to the following recipients: the Caisse des Dépôts Group, the company Systempay, the company Genapi, and the notarial office.

The data is kept for the time necessary to achieve the purpose pursued at the time of its collection.

Legal obligations may require us to retain data for a minimum period. In other cases, your data will be kept within the limit of achieving the intended purpose, specifically for the time strictly necessary to manage the business relationship, i.e., three years from the last use of our services or in compliance with applicable regulations.

Payment method data is not collected by the Notarial Office; it is collected and stored during the transaction by the Caisse des Dépôts et Consignations, which applies a strict policy to ensure the protection of the personal data it collects, namely:
  • Personal data is processed transparently and securely in compliance with individuals' rights.
  • The Caisse des Dépôts et Consignations is committed to a continuous approach to personal data protection in accordance with the amended French Data Protection Act of January 6, 1978, and the General Data Protection Regulation (EU) of April 27, 2016 (GDPR).
  • The Caisse des Dépôts has a Data Protection Officer (DPO) registered with the CNIL and a dedicated team for personal data protection.
  • The Caisse des Dépôts et Consignations' personal data protection policy describes what types of personal data may be collected and processed, how they are used, and the circumstances under which they may be disclosed.
  • You can access, rectify, request the deletion of your data, or exercise your right to restrict the processing of your data. You may withdraw your consent to data processing at any time. You can also object to the processing of your data and exercise your right to data portability.
