The amount paid to the notary under the "provision for fees," commonly and incorrectly referred to as "notary fees," actually includes:
- Taxes,
- Disbursements,
- Formalities,
- The notary's remuneration.
This remuneration can take two distinct forms: fees or Fees. Fees are calculated based on a percentage and a flat rate for each formal procedure, all set by government decree.
The notary’s fees are therefore the same for all notaries in France.
This system of remuneration has a redistributive purpose, allowing the fees from larger cases to cover the cost of smaller cases, where the fee amount does not cover the actual cost of the service.
Fees, on the other hand, are freely set by the notary. They apply, in particular, to commercial matters or for legal advice.
